Native Extortion and the Federal Criminal Code

Below is an extract from the Federal Criminal Code related to Extortion. As you may be aware the Six Nations Warriors and their supporters have violated this section of the criminal code. They have successfully extorted the Douglas Creek Estates (DCE) lands from Henco Industries through the use of threats, accusations, menaces and violence. As you will see by reading the attached communication between me and Jane Stewart the Province of Ontario considered the deed held by Henco Industries to be valid from the start. This crime was completed when the land was purchased from Henco Industries by the Province of Ontario. Henco had been put in the position of having to sell the land as the Province and the Ontario Provincial Police refused to do anything about the perpetrators of the crime (this is called duress). Had the Province approached Henco Industries under normal circumstances e.g. in January 2006 prior to the occupation, there would be no reason for Henco to sell. It was only because of the ongoing crime being committed that Henco Industries felt obliged to sell to recover their investment. It is my contention that the land currently owned by the Province is actually proceeds from the commitment of Extortion by the Six Nations Warriors; therefore, the land is subject to seizure by the courts as proceeds of the commitment of a crime.

Extortion

346. (1) Every one commits extortion who, without reasonable justification or excuse and with intent to obtain anything, by threats, accusations, menaces or violence induces or attempts to induce any person, whether or not he is the person threatened, accused or menaced or to whom violence is shown, to do anything or cause anything to be done.

Extortion

(1.1) Every person who commits extortion is guilty of an indictable offence and liable

(a) where a firearm is used in the commission of the offence, to imprisonment for life and to a minimum punishment of imprisonment for a term of four years; and

(b) in any other case, to imprisonment for life.

Saving

(2) A threat to institute civil proceedings is not a threat for the purposes of this section.

The natives have clearly stated publicly that they have no intention of leaving DCE (the object of the extortion), that if anyone tries to interfere with them then they will impart violence on the community at large (threats, menace and violence) and they consider that they are “at war”.

 All the body language of the Six Nations Warriors is of one who has all but successfully extorted the land from the rightful owner. The Province was beneficiary of this crime as Henco Industries was effectively put in a position where there was no recourse other than to sell. The Province participated in this crime, either knowingly or otherwise, by allowing the Ontario Provincial Police to not uphold the “Rule of Law” in Caledonia and by not dealing with the crime as part of its role in Canada.

 The Ontario Building Code clearly requires that a proper process must be followed before construction of any kind can take place on a property owned by anyone in Canada. The Province is now the owner of DCE and is responsible for all activities on its property. Haldimand County must issue building permits before construction can take place on this site and there is no evidence that any such permits have been issue to the Six Nations occupiers. 

The quote attached was from a resident of Caledonia on September 20, 2006 and is only one of an ongoing number of situations in which the Ontario Provincial Police refuse to do their duty as police officers with clear support of the Provincial Government. 

Actions required, 

  1. Charges of Extortion issued and prosecution against the Six Nations Warriors
  2. All Six Nations citizens either directly or indirectly involved in the extortion arrested and prosecuted for aiding and abetting
  3. An external investigation of the Ontario Provincial Police into why they are behaving the way they are with regard to the tax paying citizens of Caledonia and their handling of this crime (preferably by the Royal Canadian Mounted Police).

I need an answer from the Province immediately.
